Infant Wrongful Death: What You Need to Know

Wrongful death is when a person dies as a result of someone else’s negligence or bad actions. When it comes to infants, there is always a risk of injury and possible death during childbirth. However, when that death is a result of medical malpractice, it becomes wrongful. Here is what you need to know about Infant wrongful death.

Causes

There are a variety of different birth injuries that can lead to an infant’s wrongful death. However, there are some that are more common than others. Some of the more common fatal birth injuries are:

 

  • Oxygen Deprivation: This occurs when an infant isn’t getting enough oxygen to the brain during or shortly after birth. Oxygen deprivation is one of the main causes of birth injuries such as Cerebral Palsy, but can also lead to infant wrongful death. Death from oxygen deprivation typically is because of labor stress, problems with the placenta, or an umbilical cord getting wrapped around the baby’s neck.
  • Reduced Blood Flow: During childbirth, a baby needs the right amount of blood flow in order to keep oxygen flow to their brains and organs. If the baby isn’t getting enough blood for too long or if blood flow stops altogether, the brain and all major organs will shut down.
  • Traumatic Injuries: A traumatic injury will often lead to infant wrongful death and most often occur during a difficult delivery. Infant distress can be a very difficult situation to deal with, especially if the baby is still inside of the birth canal. This can lead to doctor having to use alternative methods to deliver the baby. Methods such as a forceps or vacuum extraction may be necessary if the baby is in distress, but can also cause serious injury or death if the doctor isn’t careful.

 

Wrongful Death Cases

Judges and lawyers typically evaluate the events that occurred before, during, and after the incident to determine if the medical staff did everything they were supposed to do. Stillborn births are not automatically the fault of the medical professional. Most states require that in order it to qualify as a wrongful death, the infant must have been capable of surviving on their own when the medical negligence occurred that led to the stillbirth. In short, it must be proven that the medical negligence alone is what led to the infant wrongful death.
