How Long Does a Medical Malpractice Claim Take to Settle?

In 2006, the New England Journal of Medicine did a study that revealed the average time duration of a medical malpractice case is five years.  However, there are many factors going into this number, and not all of them can be predicted.  The number varies wildly, and you may spend anywhere between a year to several years settling your case.  In general, the more complicated and foggy your case is, the longer it will take to settle.  Read on to learn more about what could cause your medical malpractice case to have an extended lifespan.

A Complicated Claim

 

A plaintiff might run into a few issues with their case when multiple parties could be involved in the incident.  For example, if a patient has two surgeries in the same week by two different doctors, and then discovers she has an infection.  Who is responsible for the infection?  This would make the case complicated, as it involves many different parties.  Thus, the case would be longer.  Likewise, this makes it more difficult to schedule depositions–with more people who need to clear their calendars, there’s more risk for complication.
