After a car accident, insurance companies want to find out who is liable for the accident. Liability determines who is responsible for paying damages caused by the accident. Maryland law does not require police officers to write reports for every accident reported to them.  Maryland Law does not require you to report every accident, however, it is very risky, for you not to do so.  The reason being is, that while it is not required by the state of Maryland, your insurance company may require in your contract that you report all accidents to the police for them to pay out in certain claims.  Therefore, it is recommended that the police be called in every accident.  Let the Police determine if a report is required to be made. 

What If There is No Police Report After an Accident?

Police officers do not always write police reports for car accidents. In many cases, the officer will not write a report because the car accident was not serious enough or because the car accident did not result in any severe injuries. It is important to remember that the police officer does not make any determinations of fault, in your case. They are simply recording the information about your crash. However, the lack of a police report does not affect your ability to file a claim against the at-fault driver. The insurance company and, sometimes, a judge or jury will decide who is responsible for a car accident and what damages will be awarded.

Proving Fault Without a Police Report

It is still possible to determine fault without a police report in many accident claims. When insurance companies don’t have access to police reports, they will gather information and evidence from all parties and any available witnesses. That is why it is essential to collect your own proof after an accident by taking photos or video, getting copies of identification and insurance documents, and recording contact information from other drivers and witnesses.
