In most cases, the closest family members to the deceased person in question will claim a wrongful death.  This includes spouses, children and parents of the decedent.  Areas of compensation can include: funeral costs, loss of emotional companionship, pre-death suffering, medical costs, loss of inheritance, loss of expected income, and loss of care or guidance.  Also the Decedent has a claim that survives his/her death.  This is known as a survivor action.  An individual will be appointed as the Personal Representative of the Decedent’s estate and will bring the survivor claim on behalf of the Descendent.
