The Most Common Types of Birth Injury Lawsuits in MD

One of the most common types of birth injury lawsuits in MD, Cerebral Palsy results from brain damage during labor and causes impairments to a child’s motor and brain function.

Though most deliveries are successful, the labor and delivery process is a very complex one and there is always a chance of mistakes. When medical mistakes occur during the delivery process, it can lead to birth injuries. If the injury was a direct result of the medical mistake, a lawsuit may be brought on. Here are the most common types of brain birth injury lawsuits in MD.

Cerebral Palsy

This is a condition that is caused by brain damage at some point during the labor process. The brain damage occurs as a result of an oxygen shortage to the brain. The severity of the condition depends on how long the baby was deprived of oxygen. Cerebral Palsy, depending on the type, can affect the child’s motor function and mental development in certain areas. Children may have problems with speech, movement, vision, learning, posture, and more.

Erb’s Palsy

Also known as Brachial Plexus Palsy, Erb’s Palsy is caused by trauma to a child during the labor process. It is known as Brachial Plexus Palsy because it occurs when damage is done to the Brachial Plexus nerves. The medical malpractice normally takes place during a difficult delivery when a baby’s shoulder gets stuck under the mother’s pubic bone. This requires doctors to use more force than usual to get the baby out. Sometimes, doctors may use too much force, hence causing nerve damage to the shoulder area and leading to birth injury lawsuits. This can cause children to have a loss of control or sensation in their neck, shoulders, arms, or hands.

Kernicterus

Birth injury lawsuits commonly come from this birth injury because it can rarely happen without the presence of medical malpractice. Kernicterus occurs when there is too much bilirubin present in a child’s blood. This leads to severe jaundice, causing a child’s skin to become a yellow color. Kernicterus can typically be treated without a birth injury but if left untreated, it can cause serious and permanent brain damage. When it comes to birth injury lawsuits, the hardest thing to prove is that the child’s bilirubin level is what caused the brain damage. If it did, it must then be proven that if the doctor acted differently, the child would not have sustained the injuries.
