What is Negligence?

Before we get into what medical negligence is, it is important to know what negligence is in general. Negligence is when a person breaches their legal duty in a given situation. For example, auto accidents often occur because of a person’s negligence. When driving, we have a legal duty to obey all traffic laws and drive responsibly. If a person is speeding and that leads to an accident, that person acted negligently.

With medical professionals, their legal duty is to provide their patients with a certain standard of care. This standard of care is the level of care that any reasonably competent and skilled medical professional would provide their patient in the same circumstances. Medical negligence occurs when a medical professional breaches that duty and does not provide the correct standard of care to a patient.

Medical Malpractice

Medical negligence does not automatically equate to medical malpractice. In order for medical negligence to become medical malpractice, the negligence must have directly caused an injury or worsened condition to the patient. If the negligence didn’t have any impact on the patient or if there was another reason for their injuries, then it does not count as medical malpractice and a lawsuit can’t be filed.
