What To Do if You Suspect Nursing Home Abuse

nursing home abuse

It’s important to keep a record of any complaints or interactions you may have with a facility’s staff.

Moving a loved one into a nursing home or assisted living facility is a difficult decision. Family members must put an enormous amount of trust into the facility and its employees. When you suspect this trust is being violated with negligent care, it can be heartbreaking. If your loved one has suffered an injury due to abuse or neglect, you are entitled to seek justice by filing a medical malpractice claim against the facility. Like any other type of medical malpractice case, there are things you can do to help your case and things that must be shown to have a successful case.

Record Keeping

The most important part of any nursing home abuse claim is proper record keeping. Whenever you bring an issue to the attention of a nursing home employee be sure to document the day, complaint and the employee’s response. Your medical malpractice lawyer will be able to use this information as the basis of your claim.

Proving negligence

In order to prove negligence you must provide evidence of three things. First, that the nursing home owner or employee violated the duty of care they owe the resident. Second, that as a result the resident suffered an injury.  Finally, you need to be able to show that the staff member’s conduct was the cause of the resident’s injury. Keeping a detailed record of injuries and interactions with staff will go a long way to helping prove your claim.
