The Types of Damages in a Personal Injury Case

These damages include things like loss of earnings, medical bills, future medical care costs, loss of future earnings, and household expenses.

General Compensatory Damages

The other type of compensatory damages are general, which refers to the non-monetary aspect of your personal injury case. When an injury occurs, we not only suffer physically, but mentally as well. They are referred to as general because it covers the harm that it is generally sustained in any injury. The most common types of general compensatory damages are pain and suffering, mental agony, and loss of companionship.

Punitive Damages

These damages are more complex and only come into the picture when foul play is suspected. Punitive damages are given to victims of a personal injury case when the defendant’s actions are considered “despicable”. A good example of this is when the plaintiff suffered injuries as a result of the defendant attempting to rob or assault them.

Wrongful Death Damages

When a wrongful death occurs, a personal injury case can be brought on. However, these damages are awarded to the surviving family members of the person who is deceased. The family members closest to the deceased person are the ones that should file the claim. Wrongful death damages typically cover funeral expenses, pre-death medical expenses, emotional distress, loss of companionship, and the loss of financial contribution that came from the deceased.
